Sick note rules

Can a sick note be backdated? UK rules

When a fit note can cover days before it was issued, how far back it can go, and why every date on a note has to rest on an assessment.

The short answer. Yes, in certain situations. DWP guidance says a fit note can include dates before the day it is issued, for example where you were assessed earlier or your condition affected you before a note was written. It can never start on a future date, and the issue date must be the real one. How far back is a clinical judgement, not a fixed number of days.

Can a doctor backdate a sick note?

DWP’s guidance for healthcare professionals answers this directly: in certain situations, the fit note may need to include dates earlier than the date of the statement. Two examples it gives are an assessment that took place before the note was written, and a condition that was affecting your ability to work before anyone issued a note.

What a clinician cannot do is just as clear:

  • Change the issue date. The date of the statement is always the day the note is actually issued.
  • Start a note in the future. A fit note cannot have a start date after the day it is written.
  • Certify without an assessment. GOV.UK says the healthcare professional must assess your fitness for work before giving a fit note.

How long can a sick note be backdated?

Neither the DWP guidance nor the rules we checked set a maximum number of days. The regulations link the period to the assessment and allow the statement to be given after the assessment date, but how far back a clinician goes is left to their judgement.

In practice, that means the further back the dates, the more the clinician needs to be satisfied about how you were on those days. Be ready to explain when your symptoms started, whether you were off work, and what changed.

Why the assessment matters. Every date on a note, whether NHS or private, has to rest on what the clinician assessed. No clinician should certify days they have no basis to believe you were unfit for work.

Private doctors work to the same principle

A private medical certificate is not a fit note, but DWP guidance expects a private report to contain the same information and follow the same rules if it is to stand alongside one, and those rules tie the note to the clinician’s own assessment. A private sick note from a GMC-registered UK doctor can state dates you were unfit in the past only where the doctor’s assessment supports them. Where it does not, the doctor declines and your payment is refunded in full.

Can you backdate a self-certified sick note?

There is no need. Self-certification is always done after the event: when you return, your employer can ask you to confirm the days you were off, up to 7 calendar days. The self-certification guide explains the forms.

The gap that causes trouble is the one after day 7. If you stayed off longer without getting a note, ask your GP surgery for an assessment as soon as you can and explain the dates. Whether earlier days can be included is then the clinician’s decision. If your GP will not include them, see reasons a GP may refuse a note.

Late notes and sick pay

Your employer cannot withhold Statutory Sick Pay just because a fit note reaches them late. Telling them you are ill is a separate duty, with its own deadline, and days you were late in reporting may go unpaid unless you had a good reason. The statutory sick pay guide covers this.

Reading the dates once you have them

A backdated note shows an issue date later than the start of the period it covers. That is expected and is not a sign of a mistake. For weekends, end dates and gaps between notes, see sick note dates explained, and for the wider picture, the sick note rules.

If you are claiming Universal Credit or Employment and Support Allowance (ESA), use an NHS fit note for the whole period. A private certificate is not accepted for benefits.

Common questions

Can a sick note be backdated?

Yes, in certain situations. A fit note can cover dates before the day it is issued, but the clinician must be able to support those dates from their assessment.

Can a doctor backdate a sick note?

A doctor can include earlier dates where the guidance allows, for example if they assessed you before writing the note. They cannot change the issue date, and they cannot cover days they have no basis to certify.

How far back can a sick note be backdated?

There is no number of days in the DWP guidance we checked. It is a clinical judgement, made case by case.

Can you backdate a self-certified sick note?

Self-certification always looks back. You confirm the days you were off when you return, so there is nothing to backdate.

Will I lose sick pay if my sick note is late?

Not for that reason alone. GOV.UK tells employers they cannot withhold Statutory Sick Pay because a fit note arrives late.

Can I get a backdated sick note for depression or anxiety?

The same rule applies to every condition: the dates must be supported by the clinician’s assessment. If you have been struggling for a while before asking for help, say so. For support, see time off work with depression.
